Summary
Existing law authorizes a local public entity, defined as any county, city, district, public authority, public agency, or other entity, without limitation, that is a municipality as defined under federal bankruptcy law, to file a petition and exercise powers pursuant to federal bankruptcy law, if it either participates in a neutral evaluation process or declares a fiscal emergency and adopts a resolution by a majority vote of its governing board, as specified. This bill would require a state agency or department, within 30 days of a request, to provide any assistance, information, data, and services to a city participating in a neutral evaluation process or a bankruptcy proceeding. This bill would require any refusal to comply, or to comply within 30 days of the request, to be made in writing, transmitted to the city official or employee who made the request, and to set forth the names and titles or positions of each person in the state agency or department responsible for the refusal to comply.
