Port and maritime security: grant program: extension.

Existing law, the Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006, makes specified bond proceeds available, upon appropriation by the Legislature, to the California Emergency Management Agency (Cal EMA) as grants for port, harbor, and ferry terminal security improvements. Existing law authorizes the agency to distribute these funds to eligible grant recipients, as prescribed. This bill would provide that the unencumbered balance of any funds appropriated to the agency for purposes of these grants prior to June 30, 2009, remain available to the agency for encumbrance until June 30, 2012. By increasing the duration of an existing appropriation, this bill would make an appropriation. This bill would also make technical, conforming changes. The California Constitution authorizes the Governor to declare a fiscal emergency and to call the Legislature into special session for that purpose. The Governor issued a proclamation declaring a fiscal emergency, and calling a special session for this purpose, on January 8, 2010. This bill would state that it addresses the fiscal emergency declared by the Governor by proclamation issued on January 8, 2010, pursuant to the California Constitution.
