HR 4835: Interstate Milk Freedom Act of 2021

Interstate Milk Freedom Act of 2021 This bill prohibits federal regulation of the interstate traffic of unpasteurized milk or milk products packaged for direct human consumption under specified circumstances. Specifically, the prohibition applies if such products (1) would be considered in violation of federal law solely because they are unpasteurized; (2) are allowed by the state of origin to be distributed for direct human consumption by any means; (3) are produced, packaged, and moved in compliance with the laws of such state; and (4) are moved from the state of origin with the intent to transport them to another state that allows the distribution of such products for direct human consumption.

HR 4812: Border Health Security Act of 2021

Border Health Security Act of 2021 This bill modifies the duties and activities of the United States-Mexico Border Health Commission and the Canada-United States Pan-Border Public Health Preparedness Council and makes other changes to address health issues along the U.S. border. Specifically, the commission must cooperate with the council where appropriate, and both the commission and the council must develop strategic plans, work plans, evaluations, and reports concerning their activities. The Department of Health and Human Services must award grants to (1) eligible entities in border areas to address recommendations of the commission and the council to improve the health of border area residents; and (2) trauma centers, public health entities, and state, local, or tribal entities for infectious disease surveillance activities in border areas. In addition, the Office of the Assistant Secretary for Preparedness and Response may coordinate with the Department of Homeland Security in establishing a system that alerts clinicians and public health officials to emerging health threats in border areas. The Government Accountability Office must evaluate commission and council activities every two years.

HR 4820: Health Agency Check-Up Act

Health Agency Check-Up Act This bill establishes a bipartisan commission to review and recommend whether to modify or eliminate statutory reporting requirements that apply to the Centers for Disease Control and Prevention (CDC), the National Institutes of Health (NIH), and the Food and Drug Administration (FDA). To inform this effort, the CDC, the NIH, and the FDA must provide the commission with relevant recommendations and information about their respective staffing, budgets, programs, reports, and regulations. The bill automatically makes any provision of law requiring a report that the commission recommends for elimination ineffective after 45 days, unless Congress enacts a joint resolution disapproving of the recommendation.

HR 4334: American Energy First Act

American Energy First Act This bill addresses the onshore and offshore production of traditional (e.g., oil and gas) and alternative (e.g., solar and wind) energy resources and establishes requirements for distributing revenues generated from energy production, including revenues to states and territories for conservation efforts. For example, the bill limits the President's authority to (1) withdraw areas of the Outer Continental Shelf (OCS) from oil and gas leasing, and (2) declare new marine national monuments. In addition, the Department of the Interior must obtain congressional approval before declaring a moratorium on issuing leases on federal lands or waters for oil, gas, or coal. Further, the bill requires Interior to defer to state regulations, guidance, and permit requirements for all activities regarding hydraulic fracturing (i.e., fracking) relating to oil, gas, or geothermal production activities on federal land. Interior may delegate decisions about issuing oil and gas drill permits on federal land to states. Interior must also establish certain federal land as geothermal, solar, and wind energy leasing priority areas. The bill also allows Interior to conduct certain lease sales, such as offshore wind lease sales on the OCS in the U.S. Exclusive Economic Zone adjacent to U.S. territories, and establishes requirements for distributing revenues from such leases to the Treasury, the Coral Reef Conservation Fund established by this bill, and U.S. territories.

The pass covers the entrance fee and standard amenity recreation fee for all federal recreational lands and waters.

S 2552: LIFT Act

Local Infrastructure Funding & Technical Assistance Act or the LIFT Act This bill authorizes the Department of Commerce to provide grants under the Public Works and Economic Development Act of 1965 for predevelopment projects—measures required to be completed before construction of resilient climate infrastructure occurs—and related technical assistance. Grants may be provided to economic development districts, states, Indian tribes, local governments, institutions of higher education, individuals, and other organizations as specified by the bill.

S 2565: Expanding Access to Palliative Care Act

Expanding Access to Palliative Care Act This bill requires the Center for Medicare and Medicaid Innovation (CMMI) to test a model that provides community-based palliative care and care coordination for high-risk Medicare beneficiaries and that may replace the Medicare Care Choices Model (currently set to expire on December 31, 2021). Under the new model, multi-disciplinary teams must provide coordinated, palliative care that is available 24-7 for Medicare beneficiaries with serious illnesses or injuries, such as cancer. The CMMI must evaluate the model by comparing patients participating in the model with those outside of the model in relation to specified metrics, including the election and duration of hospice care.

S 1435: Affordable Prescriptions for Patients Act of 2021

Affordable Prescriptions for Patients Act of 2021 This bill prohibits product hopping by drug manufacturers, authorizes the Federal Trade Commission to enforce this prohibition, and imposes limits on patent litigation involving biological products. Generally, product-hopping describes a situation where, when the patents on a reference drug (or biological product) expire, the manufacturer switches to a follow-on product that is covered by a later-expiring patent. Under this bill, a follow-on product is a modified version of the reference drug that shares an indication (what the drug is used for) with the reference drug. The bill presumes product hopping has occurred when a reference drug manufacturer, after receiving notice that the Food and Drug Administration (FDA) has received an application to market a competing generic (or biosimilar) version, takes certain actions such as withdrawing the reference drug from the market and selling a follow-on product. A drug manufacturer may rebut these presumptions by demonstrating that its conduct was not intended to limit competition. The bill also limits in certain instances the number of patents that a reference biological product manufacturer can assert in a patent infringement lawsuit against a company seeking to sell a biosimilar version. Specifically, if the biosimilar manufacturer completes certain actions as part of an abbreviated pathway to get FDA market approval, the bill limits, subject to exceptions and waivers, the number of certain types of patents that the reference product manufacturer may assert, such as patents filed more than four years after the reference product received market approval.

HR 4859: PAATCH Act

Patient Accessibility and Access To Community Healthcare Act or the PAATCH Act This bill allows a hospital that was designated as a sole community hospital on or before March 13, 2020, to retain this status for a 10-year period beginning on the date of the bill's enactment. Sole community hospitals are rural hospitals or hospitals that are the sole source of inpatient care in a certain geographic area. Such hospitals receive specialized treatment with respect to Medicare payment, the 340B drug discount program, and other health care programs.
