SB 153 Alabama Senate · 2024 Regular Session

Expungement , to provide that a person adjudged youthful offender for a misdemeanor offense, violation, traffic violation, or municipal ordinance violation may file a petition to have records expunged.

This bill allows individuals adjudicated as youthful offenders for minor crimes, such as misdemeanors or traffic violations, to petition for the expungement of their criminal records. It expands existing rules by including youthful offender adjudications alongside standard convictions, permitting record sealing if all fines and restitution are paid, three years have passed since the conviction, and the offense is not violent, sexual, or involving moral turpitude. The legislation also clarifies that expunged records remain accessible for specific purposes, including criminal investigations, child protection assessments, and civil lawsuits related to the original charges. Effective October 1, 2024, this law applies to cases filed in Alabama circuit courts.
