An act relating to criminal procedures involving firearms

Removed Section 1 (amending 13 V.S.A. section 2501) which would have made stealing a firearm of any value constitute grand larceny, punishable by up to 10 years imprisonment or $5,000 fine.

Added new Section 3 (13 V.S.A. section 4019a) establishing a 72-hour waiting period for firearms transfers after the licensed dealer receives a unique NICS identification number, with specific rules for mail-order transfers requiring verified tracking documentation.

Added new Section 6 (13 V.S.A. section 4824) requiring the Court Administrator to report within 48 hours to NICS when a person is found to be a person in need of treatment or patient in need of further treatment under section 4822, including identifying information and the reason for the report.

In section 4017a, changed the incompetent-to-stand-trial trigger from 'an offense listed in subdivision (4)' (which covered only carrying a dangerous weapon during a felony, drug trafficking, and human trafficking) to 'a violent crime as defined in section 4017,' broadening the scope of offenses that trigger the firearm prohibition.

Removed subdivision (5)(A)(iii) from section 4017a which would have prohibited firearm possession for anyone subject to a commitment order under section 4822 even when the underlying offense was not a violent crime.

Clarified the 'fugitive from justice' definition in section 4017a by changing 'to avoid prosecution for a crime Vermont criminal offense' to 'to avoid prosecution for a criminal offense,' removing apparent drafting error and broadening slightly to cover any criminal offense.
