An act relating to miscellaneous provisions affecting the Department of Vermont Health Access

New section (Sec. 10) amending 8 V.S.A. 4077 requires all health insurance plans to cover HIV preexposure prophylaxis drugs recommended by the U.S. Preventive Services Task Force without any deductible, coinsurance, or co-payment. Medicaid must also cover HIV prevention drugs and supportive health services (office visits, lab testing, STI testing, counseling) with no cost sharing, no prior authorization for at least one FDA-approved drug in each PrEP/PREP category, and no denial based on the type of prescriber.

New section (Sec. 2) amending 18 V.S.A. 4682 prohibits a manufacturer or its agent from requiring a 340B covered entity to submit claims, utilization, encounter, purchase, or other data as a condition for allowing acquisition or delivery of a 340B drug, unless such data sharing is required by the U.S. Department of Health and Human Services.

The deadline for the Department to seek federal approval (state plan amendment) for Medicaid coverage of doula services was extended from July 1, 2026 to July 1, 2027. The effective date for the doula certification program and Medicaid doula coverage was also changed from July 1, 2026 to July 1, 2027.

The general effective date of the entire act was changed from 'July 1, 2026' to 'on passage,' meaning all provisions without their own specific effective dates now take effect immediately upon the Governor's signature (June 8, 2026) rather than waiting until July 1, 2026.

The deadline for the Department of Vermont Health Access to seek a state plan amendment from CMS allowing Medicaid coverage of doula services was extended from July 1, 2027 to July 1, 2028.

The effective date for Medicaid coverage of doula services (33 V.S.A. 1901n) was changed from the later of July 1, 2027 or SPA approval to the later of July 1, 2028 or SPA approval.

The introductory page containing sponsor information (Rep. Berbeco), committee referral, subject line, and statement of purpose was removed from the official version.

New section amending 18 V.S.A. 4682 requires drug manufacturers or their agents to offer 340B pricing to covered entities and contract pharmacies as a discount at the time of purchase, and prohibits offering 340B pricing in the form of a rebate.

The deadline for the Department to seek a federal state plan amendment for Medicaid doula services coverage was extended from July 1, 2026 to July 1, 2027, and the effective date for that coverage was correspondingly changed from the later of July 1, 2026 or federal approval to the later of July 1, 2027 or federal approval.
