An act relating to use of administrative use controls at contaminated sites

This bill allows Vermont's Secretary of Natural Resources to implement administrative use controls at contaminated sites to reduce hazards from hazardous materials. The measure enables property owners or those responding to site releases to petition for written agreements that restrict specific property uses, such as limiting what activities can occur on the land. The Secretary must approve these controls only if they adequately protect human health and the environment, are consistent with approved cleanup plans, and ensure current and future owners understand the restrictions. The controls remain in effect until the property owner petitions for their removal by demonstrating natural attenuation of contamination or completing a new corrective action plan that meets environmental standards.
