An act relating to radiologist assistants

The requirement for where radiologist assistants may practice changed from 'the same health care facility' with a separate proviso that the assistant's work site must be in Vermont, to requiring both parties to be employed at the same 'Vermont health care facility.' This shifts the geographic restriction from the assistant's location to the facility itself.

The definitions of 'Supervision' and 'Readily available' were restructured. Previously they were separate numbered items (8) and (9). Now 'Supervision' is item (8)(A) with 'readily available' as a sub-clause (8)(B), making the availability concept explicitly subordinate to the supervision definition.

A statement of purpose section was added at the top of the bill, summarizing that radiologist assistants may provide services without a physically present radiologist if one is available remotely and a physician is on site for emergencies.

The statement of purpose section was removed, which is standard legislative procedure when a bill passes through a chamber. No policy content was altered.

A new definition of 'radiologist' was added (subsection 6) requiring that the person be licensed to practice medicine or osteopathy AND either be certified by (or eligible for certification by) the American Board of Radiology or the American Osteopathic Board of Radiology, or be credentialed by a hospital to practice radiology full-time.

The definition of 'readily available' was restructured from a sub-definition nested under 'supervision' into its own standalone definition (subsection 8), making it independently applicable throughout the chapter.

A new requirement was added in section 2857(a)(3) that the primary supervising radiologist and the radiologist assistant must be employed by and have as their primary work site the same health care facility or an affiliate of that facility, with the additional condition that the radiologist assistant's primary work site must be located in Vermont.

The enacted version clarifies that the primary supervising radiologist does not need to be physically present at the same location where the radiologist assistant is practicing, as long as a supervising radiologist is readily available for consultation and intervention. This was previously only implied by the 'readily available' definition.
