FAUCI Act

S 4232 (FAUCI Act) prohibits former top officials from the National Institutes of Health (NIH), Food and Drug Administration (FDA), or Centers for Disease Control and Prevention (CDC) from serving on boards of drug, biological product, or medical device companies within 8 years of leaving government. It also bans these individuals from profiting from drugs or devices they helped approve during their federal service, imposing a $250,000 civil penalty and up to 5 years in prison for violations. The bill requires current and former top officials to disclose ownership of patents related to drugs or devices within 180 days (or 90 days after becoming a top official), with "top official" defined as GS-13+ roles or staff involved in drug/device approvals. These provisions apply to all covered health agencies and aim to prevent conflicts of interest in medical research and approval processes.
