S 1588 United States Senate · 118th Congress

Respect for Grieving Military Families Act

This bill requires the Department of Defense to automatically forgive overpayments of military retirement pay that were mistakenly paid to a joint bank account after a service member's death. It directly affects military families who received these payments through a joint account with a designated beneficiary. The key provision eliminates the need to collect the overpayment from the beneficiary, instead forgiving it entirely (or adjusting Survivor Benefit Plan annuity payments over 12 months if the beneficiary is entitled to those payments). The policy change applies to deaths occurring on or after the bill's enactment date.
