HR 9385 United States House · 118th Congress

Protecting Americans from Social Security Clawbacks Act

This bill limits the Social Security Administration's ability to recover overpayments caused by its own errors. It prevents the agency from demanding repayment if an overpayment resulted from a Social Security mistake and occurred more than three years before the error was discovered. Exceptions apply if the recipient committed fraud or similar fault. The law affects Social Security and Supplemental Security Income (SSI) beneficiaries who received incorrect payments due to agency errors. It amends existing Social Security Act provisions to establish these recovery restrictions.
