Medical Records Access Fairness Act of 2024
This bill, the Medical Records Access Fairness Act of 2024, prohibits health care providers from charging fees for patients to access their own medical records (or summaries/explanations) under most circumstances. It specifically eliminates fees for the first copy requested in a calendar year, for electronic access via online portals, and for transmitting records to other health care providers as requested. Providers may still charge for duplicate copies requested within the same year or for non-electronic copies when online access is available. The law takes effect 180 days after enactment, requiring the Health and Human Services Secretary to issue implementing regulations within six months.
