Stop Commercial Use of Health Data Act

This bill prohibits covered entities (like health apps, wearables, or health data brokers that collect health data from 1,000+ people annually) from using personally-identifiable health data for commercial advertising. It gives individuals the right to access and request deletion of their health data within 45 days, without fees, in both human- and machine-readable formats. The Federal Trade Commission enforces these rules as unfair business practices, and individuals can sue for $1,000 per violation of the advertising ban or actual damages for other violations. Public health campaigns are exempt from the advertising prohibition.
