SB 1457 Texas Senate · 89th Legislature (2025)

Relating to a district or county attorney participating as counsel in certain proceedings.

This bill prohibits current and former district or county attorneys from representing parties against the state in legal cases they previously handled for the state. Specifically, it bars them from serving as "of counsel" (legal representatives) in any case where they would be adverse to the state, except in limited family court cases under Chapter 262 of the Family Code. The restriction applies to both current attorneys and those who have left the position, preventing conflicts of interest in future cases. This law takes effect September 1, 2025, and only applies to offenses committed on or after that date.
