Relating to a cause of action for drag performances performed in the presence of a minor.

HB 938 creates a new legal cause of action allowing minors (under 18) to sue promoters or performers of drag shows if the performance violates community standards for content suitable for minors and reasonable steps weren't taken to restrict minor access. The bill defines "drag performance" as gender-expressive acts involving clothing/makeup performed in a "lascivious" (sexually offensive) manner, and specifies that minors must prove both the content was inappropriate for their age and access controls failed. If successful, plaintiffs may recover actual damages (including emotional harm), $5,000 in statutory damages, and attorney fees. This law applies only to claims arising on or after its effective date of September 1, 2025.
