School boards and charter school governing bodies must establish a sick leave pool program where retiring employees contribute accrued sick leave days to a shared pool.
School districts must include information about the sick leave pool program and employee rights in their informational handbooks and leave request forms.
Current employees who have exhausted their granted sick leave days become eligible to use sick leave from the pool, subject to existing district or school policies.
Schools that adopted sick leave policies before September 1, 2025 are exempt from creating the pool if doing so would conflict with their existing policies.
The bill takes effect on September 1, 2025, with immediate effect requiring a two-thirds vote from both legislative houses.
