Relating to civil actions related to groundwater conservation districts.

HB 2805 amends Texas Water Code Section 36.066 to change how legal fees are handled in civil cases involving groundwater conservation districts. It allows districts to recover attorney's fees and costs if a lawsuit against them is found to be groundless and brought in bad faith (subsec g). The bill also creates a new provision (subsec g-1) enabling groundwater rights owners to seek similar fee recovery if a district intentionally violates their statutory or constitutional rights. These changes apply only to cases filed on or after September 1, 2025, and require courts to award fees only for issues where the party prevails.
