SB 2633 Tennessee Senate · 114th Regular Session (2025-2026)

Taxes - As enacted, adds to the definition of a "qualified public use facility" as used in the Local Tourism Development Zone Business Tax Act a mixed-use development containing a performance venue with a seating capacity of at least 2,500; authorizes a municipality or public authority that has financed a qualified public use facility within a tourism development zone and that qualifies for an allocation of sales tax revenue from within that zone under the Convention Center and Tourism Development Financing Act of 1998 and under other provisions of sales tax law to use the revenue for purposes authorized in the act or other law. - Amends TCA Title 7 and Title 67.

SB 2633 expands eligibility for tourism-related tax revenue by adding mixed-use developments containing performance venues with 2,500+ seats to the definition of "qualified public use facility" under Tennessee's tourism tax laws. It allows municipalities or public authorities that have financed such facilities within tourism development zones to use allocated sales tax revenues for authorized purposes, including these new developments. The bill specifically targets large-scale projects requiring $300 million+ in public and private investment, covering venues alongside retail, hotel, or residential components. This change directly affects local governments managing tourism zones seeking to fund qualifying developments through existing tax allocation mechanisms. The bill amends Tennessee Code Sections 7-88-114 and 67-4-3002.
