HB 1660 Tennessee House · 114th Regular Session (2025-2026)

Nuisances - As introduced, prohibits any cause of action for nuisance, taking, or another claim against a racing facility or racetrack by the owner of a surrounding real property if the racing facility or racetrack was built before the owner of the surrounding real property purchased the real property or built in the area of the racing facility or racetrack, regardless of the date on which the cause of action is alleged to have arisen; prohibits a political subdivision from adopting or enforcing any ordinance, resolution, or regulation that would restrict, limit, or prohibit the operation of a racing facility or racetrack in a manner inconsistent. - Amends TCA Title 4; Title 5; Title 6; Title 7 and Title 29.

HB 1660 prevents neighbors from suing racing facilities or racetracks over noise, disruption, or other issues if the track existed before they bought or built their property. It applies to all claims filed after the law takes effect, regardless of when the alleged problem began, and blocks local governments from passing rules that restrict racetrack operations. The law does not override environmental or safety regulations. This directly affects property owners who purchased land after a racetrack was established and protects existing racetracks from certain lawsuits.
