SB 2654 Tennessee Senate · 113th Regular Session (2023-2024)

Criminal Offenses - As enacted, establishes Class B misdemeanors for the tampering or otherwise making ineffective certain monitoring devices required as a condition of probation or parole; makes related changes. - Amends TCA Title 40.

This law makes it a Class B misdemeanor for people on probation, parole, or bail to intentionally damage, remove, or disable their required monitoring devices, such as transdermal or GPS trackers. It also criminalizes anyone who helps another person commit these acts. The bill requires monitoring companies and bail agents to immediately report any tampering or device failures to the relevant court or supervising authority. Additionally, these violations can lead to the revocation of bail or probation and may trigger a legal surrender process. The changes apply to individuals under supervision in Tennessee starting July 1, 2024.
