Pharmacy, Pharmacists - As enacted, authorizes the board of pharmacy to register any mechanical or electronic systems that operate solely on the premises of a hematology or oncology clinic in this state and that perform the storage, control, and dispensing of commercially available drug products pursuant to a valid patient-specific prescription, as part of the operations of a licensed pharmacy; makes related changes. - Amends TCA Title 29; Title 53; Title 56; Title 63; Title 68 and Title 71.
This bill allows licensed pharmacies in Tennessee to register and operate automated systems that store, control, and dispense prescription drugs exclusively within hematology or oncology clinics. The legislation specifically enables approved pharmacies to inspect, restock, and re-dispense unopened, unused specialty medications that are returned from healthcare facilities by providers. To ensure safety, pharmacists must verify that returned drugs remain in their original, unopened packaging before they can be reused, and the pharmacy must provide financial credit or reimbursement to the entity that originally paid for the medication. Additionally, the law outlines specific record-keeping requirements for these transactions and establishes liability protections for pharmacists and manufacturers acting in good faith during the restocking process.
