HB 2931 Tennessee House · 113th Regular Session (2023-2024)

Judges and Chancellors - As enacted, requires a judge who enters into a deferred discipline agreement regarding a matter before the board of judicial conduct to sign an affidavit stating that the judge consents to the recommendation of the investigative panel, the consent is freely and voluntarily rendered, there is a pending proceeding involving allegations of misconduct, which must be specifically set forth in the affidavit, and the facts set forth in the affidavit are true; requires the affidavit to be filed with the board upon its approval by a hearing panel. - Amends TCA Title 16 and Title 17.

This law requires judges in Tennessee to sign a sworn statement before agreeing to a deferred discipline agreement for misconduct allegations. The affidavit must confirm that the judge voluntarily agrees to the panel's recommendation, that a specific misconduct case is pending, and that all facts in the statement are true. Once signed, the document must be submitted to the board of judicial conduct for its approval. This process adds a formal verification step to ensure judges understand and accept the terms of their disciplinary resolution.
