Relating to home ownership; and declaring an emergency.

Establishes Task Force on Addressing Racial Disparities in Home Ownership. Directs task force to compile data concerning levels of home ownership among people of color in this state and identify barriers to home ownership. Requires task force to recommend solutions, including legislation, to modify practices or procedures for mortgage loan applications and approvals to eliminate any impermissible discrimination or barriers. Requires task force to report to Legislative Assembly by September 15, 2019. Sunsets December 31, 2019. Declares emergency, effective on passage.

Relating to electricity for motor vehicles; and prescribing an effective date.

Permits state agency to locate devices or facilities for providing electricity to public for electric motor vehicles in locations sufficient to meet demand for devices or facilities. Requires Oregon Department of Administrative Services to establish criteria for determining appropriate number of locations for devices and facilities. Provides that state agency shall set price for electricity that recovers, to extent practicable, costs of operating or administering devices or facilities and that does not exceed 110 percent of market price in county for delivering electricity to public for electric motor vehicles. Requires state agency to set uniform price for electricity in accordance with criteria and calculation that department specifies. Requires Oregon Department of Administrative Services to report to Legislative Assembly not later than February 1, 2019, February 1, 2021, and February 1, 2023, concerning state agency implementation of authority granted in Act. Takes effect on 91st day following adjournment sine die.

Relating to Internet service providers; and declaring an emergency.

Prohibits broadband Internet access service provider from disclosing, selling or permitting access to personal information of customers of provider. Creates exceptions, including exception for giving express consent. ] Requires broadband Internet access service provider to take reasonable measures to protect personal information of customers of provider. ] Requires broadband Internet access service provider to provide notice of provisions of Act to potential customers of provider. ] Makes violation of Act unlawful trade practice. ] Establishes Task Force on Broadband Security to study uniformity of laws throughout United States with respect to protecting customers of broadband Internet access service providers. Requires task force to submit report, including recommendations for legislation, to interim committee of Legislative Assembly related to judiciary no later than December 15, 2018. ] Prohibits public bodies from contracting with broadband Internet access service providers that engage in certain network management activities based on paid prioritization, content blocking or other discrimination. Provides limited exceptions, including for activities necessary to address needs of public safety and law enforcement. Becomes operative January 1, 2019. Declares emergency, effective on passage.

Relating to the price of prescription drugs; and declaring an emergency.

Requires prescription drug manufacturer to report annually information to Department of Consumer and Business Services regarding prices of prescription drugs and costs associated with developing and marketing prescription drugs. Authorizes department to impose civil penalties on manufacturer for failing to comply with reporting requirements. Requires health insurers that offer prescription drug benefit to report to department specified information about prescription drug prices and impact of prescription drug prices on premium rates. Authorizes department to adopt by rule fees on manufacturers. Requires department to conduct annual public hearing on prescription drug prices and related information reported by manufacturers. Establishes Task Force on the Fair Pricing of Prescription Drugs. Specifies membership and duties. Requires task force to submit report to Legislative Assembly by November 1, 2018. Declares emergency, effective on passage.

Relating to damages for civil causes of action that take into account race or ethnicity of plaintiff.

Prohibits fact finder from determining plaintiff's damages for civil cause of action using calculation for projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff. ] Makes calculation of projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff inadmissible in civil action. Directs court to instruct jury in civil action involving claim for projected future earnings that jury may not consider race or ethnicity of plaintiff.

Relating to engine emissions; prescribing an effective date.

Requires certain public improvement contracts to meet certain requirements related to use of diesel engines in course of performing public improvement contract. Requires Environmental Quality Commission to adopt indirect source review program by rule. Requires certain nonroad diesel engines to be registered with Department of Environmental Quality. Authorizes commission to adopt rules and registration fees. Directs commission to adopt by rule diesel engine emission standards for medium-duty trucks, heavy-duty trucks and nonroad diesel engines. Requires commission to phase in implementation of certain standards. Makes certain provisions operative January 1, 2019. Authorizes additional uses of moneys received by state pursuant to Volkswagen Environmental Mitigation Trust Agreement. Repeals state preemption of local regulation of idling by primary engines in commercial vehicles. Takes effect July 1, 2018.

Relating to safe transportation of hazardous substances; prescribing an effective date.

Directs Environmental Quality Commission to adopt rules applying certain oil spill prevention and emergency response planning requirements to railroads that own or operate high hazard train routes in this state. Modifies certain requirements under oil or hazardous material spillage statutes. Requires railroads that own or operate high hazard train routes to submit annually certain proof of financial responsibility for high hazard train routes. Establishes High Hazard Train Route Oil Spill Prevention Fund. Continuously appropriates moneys in fund to Department of Environmental Quality to be used for costs related to contingency planning and preparedness for high hazard train routes. Becomes operative January 1, 2019. Takes effect on 91st day following adjournment sine die.

Relating to fees for securing a consumer's credit information; declaring an emergency.

Removes ability of consumer reporting agency to charge fee for placing, temporarily lifting or removing security freeze on consumer report, for creating or deleting protective record or for placing or removing security freeze on protective record for protected consumer or for replacing lost personal identification number, password or similar device for consumer. Declares emergency, effective on passage.

Relating to greenhouse gas emissions; declaring an emergency.

Requires Environmental Quality Commission to adopt by rule program that places cap on greenhouse gas emissions and that provides market-based mechanism for covered entities to demonstrate compliance. Establishes program advisory committee. Declares legislative purposes of program and related investments of moneys received as proceeds under market-based compliance mechanism. Establishes certain statutory funds in State Treasury. Requires certain moneys received as proceeds under market-based compliance mechanism to be deposited in certain funds. Requires certain uses of moneys deposited in funds. Requires program advisory committee to submit biennial report to Governor and Legislative Assembly each even-numbered year. Requires Governor to consider investment and expenditures recommendations in biennial report during preparation of Governor's budget. Makes all provisions related to program adopted by commission and distribution of proceeds operative January 1, 2021. Authorizes commission and certain other agencies to adopt rules prior to operative date. Repeals greenhouse gas emissions goals and requires commission to adopt by rule statewide greenhouse gas emissions goal for 2025 and limits for years 2035 and 2050. Defines "greenhouse gas" for air pollution laws. Establishes Joint Legislative Committee on Climate. Modifies registration and greenhouse gas reporting requirements for certain persons. Makes provisions related to Joint Legislative Committee on Climate, greenhouse gas definition, emissions limits and registration and reporting operative January 1, 2019. Requires certain persons to pay annual program development fee to Department of Environmental Quality. Becomes operative July 1, 2019. Sunsets January 2, 2021. Provides for expedited review of Act by Supreme Court upon petition by adversely affected party. Declares emergency, effective on passage.
