MINOR
The bill moved from a draft version to its final enrolled form, incorporating several substantive additions to strengthen financial responsibility requirements. The most significant change is the addition of specific mandates for self-insurance, requiring operators to pass solvency or credit tests, provide quarterly reports, and offer guarantees. The bill also clarifies that certificates must be renewed every three years or upon ownership changes.
Scope change
The scope of enforcement was expanded by adding explicit requirements for self-insured operators to demonstrate continued financial ability through testing and reporting, which were not detailed in the previous version.
REQUIREMENT
Added specific requirements for self-insurance, mandating that operators satisfy a solvency or credit rating test, provide quarterly reports to the Department of Environmental Quality, and provide a guarantee for the required financial assurance amount.
TIMELINE
Added a requirement that certificates of financial responsibility must be renewed every three years or whenever there is a change in ownership or the identity of the certificate holder.
ENFORCEMENT
Added a new subsection requiring the commission to establish specific policies and procedures for enforcing the new financial assurance rules.
