SB 389 creates a new process for Oregon residents who have experienced recent harassment to obtain court-issued protective orders. Victims can file a petition with the circuit court within 180 days of harassment incidents that cause reasonable safety concerns, requiring specific details about the harassment. If granted, courts must hold an emergency hearing the same day or next day and can order restrictions on contact, entry to property, or electronic communication for up to two years. The law prohibits courts from restricting firearm access in these orders and eliminates fees for filing such petitions. It also establishes clear procedures for service, challenges, and hearing requests within 30 days of order issuance.
