AN ACT to create and enact a new section to chapter 4.1-01 of the North Dakota Century Code, relating to a low-carbon fuels fund; to amend and reenact sections 39-04-39 and 54-44.5-09 of the North Dakota Century Code, relating to the distribution of certain vehicle registration fees and ethanol production incentives; to repeal chapter 17-02 of the North Dakota Century Code, relating to ethanol production incentives; to provide a continuing appropriation; to provide for a transfer; and to provide for a report.

Created a new Low-Carbon Fuels Fund in the state treasury to distribute incentives for carbon-reducing projects.

Changed vehicle registration fee distribution to transfer 40% to the new low-carbon fuels fund instead of the old ethanol production incentive fund.

Added eligibility criteria for capital projects including carbon dioxide capture, storage, beneficial use, energy efficiency, and ethanol yield improvements.

Requires the commissioner to provide annual reports on fund status, distributions, and balances to legislative management.

Repealed Chapter 17-02 of the North Dakota Century Code which previously governed ethanol production incentives.

Establishes a transfer deadline of July 1, 2025, for moving remaining funds from the old ethanol incentive fund to the new low-carbon fuels fund.
