AN ACT to create and enact a new section to chapter 44-04 of the North Dakota Century Code, relating to the opportunity to provide public comment at a meeting of a public entity.

Changed from amending existing section 44-04-19 to creating a new section focused specifically on public comment opportunities rather than general meeting access.

Added requirement that at least one-fourth of publicly noticed regular meetings must include an opportunity for public comment.

Added requirement that individuals providing public comment must submit their name and address in writing to the political subdivision.

Added authority for political subdivisions to limit public comments by time per speaker, total time, or both, and to develop public comment policies.

Added specific criteria for public comments including requirements that comments be pertinent to the subdivision, not interfere with meeting conduct, and not be defamatory, abusive, harassing, or unlawful.

Added provision that public comments may be prohibited if they include confidential or exempt information or are otherwise prohibited by law.

Removed provisions regarding general meeting access, electronic capacity requirements, and rights to photograph or record meetings.
