AN ACT to create and enact a new chapter to title 15.1 of the North Dakota Century Code, relating to an education savings account program for students who are not enrolled in public school or a homeschool program; to provide an appropriation; and to provide an effective date.

The definition of 'Administrator' changed from an organization designated by the Bank of North Dakota to the Bank of North Dakota itself.

Added a new definition for 'Program manager' as an organization registered with the secretary of state and designated by the Bank of North Dakota to assist in implementation.

The subjects required in the parent agreement changed from reading, grammar, mathematics, social studies, and science to English language arts, mathematics, social studies, and science.

The hardware resale restriction period was extended from one year to three years after purchase.

The list of qualifying expenses was modified, removing references to national norm-referenced examinations and adding that private tutoring must be approved by the program manager.

The provision for depositing fifty percent of statewide average amounts into education savings accounts was removed entirely.

Added a requirement that any refunds must be returned to the administrator who will deposit funds back into the appropriate student's account.

The bill title and formatting were updated to reflect the regular session commencing January 7, 2025, and the sponsor list was reorganized.
