AN ACT to create and enact two new sections to chapter 50-11 of the North Dakota Century Code, relating to substitute caregiver and respite care provider requirements in foster homes for adults and the permitted use of an electronic monitoring device by an adult foster care provider; and to provide for a legislative management study.

Establishes minimum respite care service requirements of 220 calendar days in a 24-month period or 110 days in a 12-month period for substitute caregivers and respite care providers.

Clarifies that days where substitute caregivers or respite care providers provide more than 12 hours of care in a single day do not count toward the minimum service day requirements.

Permits adult foster care providers to employ temporary assistants for residents with physical limitations requiring multiple providers.

Allows use of electronic monitoring devices (one-way radio or video transmitter) for unattended residents within limited range, requiring written consent from the resident or their legal representative.

Defines 'respite care provider' as an enrolled qualified service provider and 'substitute caregiver' as an individual meeting qualified service provider standards who provides respite care.

Mandates a legislative management study on foster home licensing barriers during the 2025-26 interim, with findings reported to the seventieth legislative assembly.
