AN ACT to amend and reenact section 1-01-34 of the North Dakota Century Code, relating to gender usage in the North Dakota Century Code.

The definition of gender terms was changed to state that words of one gender include the other genders, and words referencing an individual's gender mean their biological sex at birth, removing explicit references to gender identity and gender expression.

The requirement that entities receiving state funding must follow the gender definition was broadened to apply to all public schools, higher education institutions, and state agencies regardless of funding status, with an exception for situations where federal law requires otherwise.

The previous requirement that contested sex, gender, gender identity, or gender expression be determined by DNA was removed from the bill.

The bill was renumbered from 25.0497.01000 to 25.0497.02000 and updated to reflect its status as an Engrossed House Bill.
