AN ACT to amend and reenact section 49-04-07 of the North Dakota Century Code, relating to unreasonable preferences or advantages from public utilities; and to repeal sections 49-04-08, 49-04-09, and 49-04-10 of the North Dakota Century Code, relating to regulation of common carriers relating to permissible discrimination, long and short hauls, and freight pooling.

Sections 49-04-08, 49-04-09, and 49-04-10 are repealed, eliminating specific rules about discrimination, long and short hauls, and freight pooling that were previously in the public utility code.

Section 49-04-07 is amended and reenacted with updated language to prohibit public utilities from giving undue preferences or advantages to specific customers or traffic types, while maintaining the prohibition against charging different rates for similar services under similar conditions.

The amended section clarifies that public utilities may enter reasonable agreements with customers or provide sliding scale charges, but these must be filed with and approved by the Public Service Commission before becoming lawful.
