AN ACT to create and enact a new chapter to title 23.1 of the North Dakota Century Code, relating to the regulation of aboveground storage tanks; to amend and reenact section 23.1-12-02 and subsection 7 of section 23.1-12-17 of the North Dakota Century Code, relating to the department of environmental quality and tank registration fees; and to provide a penalty.

Added new exemptions for tanks owned by the federal government, tanks used for transporting petroleum, small lubricating oil tanks under 1,320 gallons, and ethanol/biodiesel wholesale storage over 20,000 gallons.

Expanded exclusions to include tanks located at terminals, refineries, petrochemical plants, and facilities associated with oil, gas, geothermal, and renewable energy production.

Added new definitions for 'electric energy conversion facility' (including wind energy) and 'electric transmission related facility' to clarify which modern energy infrastructure is covered or excluded.

Added definition for 'midstream facility' to clarify that retailers and end users are not included in this category.

Added 'petroleum' definition to include gasoline, fuel oil constituents, and oil sludge/refuse for consistency with other chapters.

Updated bill numbering from 25.8051.01000 to 25.8051.02000 and changed bill status from 'Introduced' to 'First Engrossment'.
