A 8354 New York Assembly · 2025 Regular Session

Provides for a line of duty presumption for disabilities of deputy sheriffs in certain cities

This bill creates a presumption that heart conditions causing disability or death for deputy sheriffs in cities with over 1 million residents (like New York City) occurred while on duty, if the condition wasn't detected during their initial physical exam. It applies only to deputy sheriffs hired through competitive civil service who passed pre-employment health screenings. Under this law, affected deputies or their families would receive a pension equal to 75% of their final average salary upon retirement due to such conditions. The presumption does not apply to workers' compensation claims or other disability laws.
