A 2508 New York Assembly · 2025 Regular Session

Relates to liability for the manufacture, sale, leasing or other disposition of ammunition feeding devices and compensation for damages

This bill creates strict liability for manufacturers and dealers of large-capacity ammunition feeding devices (such as magazines holding more than 5 rounds for rifles/shotguns or 15 for pistols) if those devices are used in an illegal firearm discharge causing injury or death. Victims or their families can seek compensation without proving fault or defect, but the law excludes cases where the injured person was committing a crime, or the device was sold to authorized law enforcement/military personnel, or the shooter was such personnel. The bill does not limit other legal claims available to victims and applies to causes of action accruing after its effective date.
