A 11271 New York Assembly · 2025 Regular Session

Provides for a performance and discharge of duty presumption for certain impairments of health of Nassau county fire marshals

This bill creates a legal presumption that lung diseases affecting Nassau County fire marshals were caused by their work duties, rather than pre-existing conditions. It applies to various fire marshal ranks within the county who passed a health check upon hiring but later develop lung issues that cause disability. Under this rule, the condition is automatically considered work-related unless the employee can provide strong proof otherwise. The Nassau County government will cover all associated costs and may spread these expenses over ten years. The law takes effect immediately upon passage.
