S 9655 New York Senate · 2023 Regular Session

Requires utility companies to report on utility poles and remove unused utility poles in the public right-of-way

This bill requires utility companies to submit annual reports listing all utility poles they own in public areas, specifically identifying which ones are currently in use and which are unused. Under the new rules, companies must create a plan to remove any pole that is no longer needed and complete the removal within one year of identifying it as obsolete. To enforce these requirements, the state can impose fines of up to ten thousand dollars per pole for each year a company fails to remove an unused pole. The reports must be shared with state officials and legislative leaders by December 1st of every year.
