S 8780 New York Senate · 2023 Regular Session

Provides a heart disease presumption for correction officers, correction supervisors, deputy sheriff patrol or deputy sheriff patrol supervisors

This bill creates a legal presumption that heart disease affecting correction officers, correction supervisors, deputy sheriff patrols, and deputy sheriff patrol supervisors in New York was caused by their work. Under the new rules, these employees would automatically be considered to have developed their heart condition while on duty unless the state can prove they had a pre-existing heart issue before starting their job. The legislation applies to members of the state and local employees' retirement system and allows them to receive disability benefits or death benefits for heart-related conditions without needing to prove a direct link to their daily tasks. The law takes effect immediately upon passage.
