S 8632 New York Senate · 2023 Regular Session

Relates to health care proxy information and palliative care patients

This bill requires doctors and other health care providers to give information about health care proxies to patients receiving palliative care. It mandates that these professionals explain the benefits of appointing a health care agent and ensure a copy of the proxy is added to the patient's medical record. If a patient cannot understand the information due to lack of capacity, the provider must instead offer this counseling to the person authorized to make health decisions for them. The law also allows providers to arrange for a qualified specialist to deliver this information and counseling on their behalf.
