S 8529 New York Senate · 2023 Regular Session

Provides for a line of duty presumption for disabilities of deputy sheriffs in certain cities

This bill creates a legal presumption that heart-related health issues or death for deputy sheriffs in large cities are work-related injuries. It applies specifically to deputy sheriffs in cities with populations of one million or more who were hired through competitive civil service exams and passed a physical check that did not show signs of heart disease. If a deputy sheriff develops a heart condition or dies from one, the law assumes it happened while on duty unless there is strong proof otherwise, which would allow them to receive a pension equal to three-fourths of their final average salary. The measure excludes these presumptions from workers' compensation and labor law calculations but applies immediately to eligible officers.
