S 7532 New York Senate · 2023 Regular Session

Relates to removal and prohibition of directors, trustees, officers, members or partners of certain entities; repealer

This bill updates the banking law to give state regulators the power to remove and ban leaders of various financial institutions, including banks, credit unions, and mortgage companies. It allows the superintendent to take action against directors, officers, and partners if they are found to have caused legal violations, engaged in unsafe practices, or contributed to the failure of their organization. The process includes a formal notice and hearing where the individual can defend themselves, though the regulator can also temporarily suspend a person's duties for up to 360 days while an investigation is ongoing. Once an order is issued, the banned individual is prohibited from working for or managing any covered financial entity unless explicitly permitted in writing by the regulator.
