The law includes exceptions for unforeseeable emergencies, such as sudden staffing shortages, but these exceptions are capped at four additional hours and still require the aide's agreement. Home care aides gain the right to sue employers for damages if they are forced to work beyond these limits or face retaliation for reporting violations.
