PER- & POLY-FLOUROALKYL PROTECTION ACT

Added new product categories to the phased prohibition schedule effective January 1, 2028, including carpets, rugs, cleaning products, cosmetics, fabric treatments, feminine hygiene products, textiles, textile furnishings, ski wax, and upholstered furniture.

Added specific rules for firefighting foam requiring periodic inventory, emergency-only use, and cleanup of discarded foam pursuant to the Hazardous Waste Act.

Added requirements for manufacturers to submit detailed product information including descriptions, purposes, chemical quantities, and contact information to the department by January 1, 2027.

Requires manufacturers to submit detailed product information including chemical abstracts service registry numbers, exact quantities or ranges of PFAS substances, and contact information to the department by January 1, 2027.

Requires the Environmental Improvement Board to adopt rules establishing reporting ranges for PFAS levels, identifying currently unavoidable uses, and managing firefighting foam inventory and cleanup.

Mandates that the department may direct manufacturers to provide testing results within 30 days if there is reason to believe a product contains intentionally added PFAS substances.

Establishes civil penalties up to $15,000 per violation with additional administrative costs for enforcement, and up to $25,000 per day for noncompliance with administrative orders.

Added exemptions for products governed by federal law, used products offered for resale, medical devices and drugs regulated by the FDA, cooling/heating/ventilation equipment with EPA-approved refrigerants, veterinary products, motor vehicles, watercraft, aircraft, semiconductors, and products with currently unavoidable uses.

Added a new definition for 'intentionally added' to specify that PFAS substances are considered intentionally added when they are deliberately included during manufacturing and their continued presence is desired or expected in the final product.
