A 757 New Jersey General Assembly · 2026-2027 Regular Session

Permits portion of child support payments to be held in trust for child to access upon certain circumstances.

This bill allows courts to direct up to 10% of a parent's child support payments into a trust for the child, upon parental agreement. The trust, created under New Jersey's Uniform Trust Code, automatically designates the child as the beneficiary, with funds distributable at age 18 (or a specified age). Courts may amend trust terms or appoint a new trustee if the current trustee fails to act in the child's best interest. The bill does not increase the parent's total child support obligation and applies only when parents consent to the arrangement.
