What changed between versions
New subsection 6d: If an owner or operator fails to pay three or more fines, the corporation may notify the NJ Motor Vehicle Commission, which may then suspend the driver's license or vehicle registration. The corporation must notify the commission if fines are later paid or the case is dismissed.
New subsection 5c: A registered owner contesting a citation may appeal the corporation's final decision to the New Jersey Superior Court, providing a judicial review pathway that did not exist in the introduced version.
Section 2a: The person who reviews recorded images to determine whether a violation occurred was changed from 'a designated employee of the corporation, or a contracted law enforcement agency' to 'an officer with the New Jersey Transit Police Department, or an employee of the corporation that has been designated, trained, and certified by the New Jersey Transit Police Department.' This narrows eligibility and adds a certification requirement.
Section 5b: Contest procedures must now follow 'rules and regulations adopted by the corporation in accordance with the Administrative Procedure Act (C.52:14B-1 et seq.)' rather than simply 'procedures established by the corporation.' The corporation is also required to send its final decision to the registered owner with instructions for paying or appealing.
Section 5a(8): The ground for contesting a citation based on a prior paid citation was broadened from 'local parking authority' to 'local law enforcement agency or parking authority,' meaning a prior ticket from any local law enforcement agency (not just a parking authority) now qualifies.
New defined term: 'Commission means the New Jersey Motor Vehicle Commission.' This supports the new license/registration suspension enforcement mechanism.
The provision allowing the corporation to retain fines for administrative costs (with excess going to Access Link) was renumbered from subsection d to subsection e, and the prohibition on revenue-based contractor compensation was renumbered from subsection e to subsection f. No substantive change to the funding rules themselves.
The entire 'STATEMENT' section (a narrative summary of the bill's provisions) was removed, which is standard practice when a bill is reprinted after committee action.
