SCR 72 proposes a constitutional amendment requiring New Jersey courts to interpret the state constitution based on the "intention of the people" when they adopted it. It would prohibit courts from making decisions that compel state spending without legislative consent or expand/contract constitutional rights beyond the people's intended scope. The Legislature could then invalidate any court decision it deems inconsistent with the amendment via a two-thirds vote in both chambers using a concurrent resolution. This amendment would require voter approval to become part of the state constitution.
