S 1745 prohibits health care providers, mobile application developers, and third parties from collecting or sharing New Jersey residents' biometric data (like heart rate or fingerprints), health data (such as medical records), or protected health information without explicit consent. Before collecting information, consent must be obtained; for each disclosure, consent must be secured within three days prior to sharing. Exceptions include sharing for medical treatment between health care providers, and the bill does not override federal HIPAA rules. Violations could result in $1,000 per violation in damages.
