A 5927 New Jersey General Assembly · 2024-2025 Regular Session

Permits owners, agents, or other persons to elect to contract with private on-site inspection agencies to complete inspections under the construction code; provides for charging of separate inspection fee.

This bill would allow property owners, agents, or responsible persons in charge of construction projects to choose private inspection agencies for building code compliance inspections, rather than being limited to municipal enforcing agencies. Currently, owners could only use private inspectors if the municipality failed to complete inspections within three business days and with Department of Community Affairs authorization. The bill would eliminate this restriction, permitting owners to select private inspectors for any reason. It also establishes procedures for charging separate inspection fees and requires private agencies to follow conflict-of-interest rules.
