Provides for payment to small municipalities, in certain cases, of certain penalty moneys assessed for violations of fish and game laws.
This bill requires that when a small municipality (population under 2,000) adjudicates a violation of state or federal fish and game laws in its municipal court, 50% of the penalty money collected must be paid to the municipality and 50% to the Division of Fish and Wildlife. For federal violations, this 50-50 split applies only if the case is handled by the small municipality's court and federal law doesn't prohibit it. In all other cases (e.g., non-small municipalities or federal violations not adjudicated locally), penalty money continues to go entirely to the Division of Fish and Wildlife. The bill also updates a legal reference from "misdemeanor" to "crime of the fourth degree" for failing to forward collected funds.
