LC 3432 Legislature · 2025 Regular Session

Providing for disposition of abandoned graveyard lots

This bill establishes a process for determining and disposing of abandoned lots in public cemeteries in Montana, allowing individuals to petition for the sale of such lots after they have been unused for at least 75 years. The legislation requires petitioners to demonstrate they have tried to locate owners or heirs, followed by public notice published in local newspapers to alert potential claimants. If no one claims the lot after the notice period, the cemetery administrator can sell it to the petitioner at a set price, while veteran burial plots and lots containing remains remain excluded from this process. The bill applies only to public cemeteries and does not mandate private cemeteries to follow these procedures, though they may choose to adopt them.
