HB 323 requires county recorders to notify property owners when a deed changing ownership of their property is submitted for recording. The recorder must delay recording for at least five business days to allow notification via phone, text, email, or mail to the owner’s address on file. If owners confirm the deed is legitimate, the delay ends; if they report fraud, the recorder must wait an additional two business days for a court order. Exceptions apply for deeds from licensed real estate brokers or title companies that have issued title insurance.
